Could We Soon See Regulated Kratom in Pennsylvania?

There’s been a lot of talk about kratom in Pennsylvania this past summer. In June 2022, the state House of Representatives voted to ban the sale of kratom to individuals under 18 years old. Now, the American Kratom Association (AKA) is pushing for wider kratom regulations in the state. There’s a lot of confusion around these efforts, so we wanted to clear up a few facts.

Is Kratom Legal in Pennsylvania?

Yes, kratom is legal in Pennsylvania. The recent legislative effort sought to regulate—not ban—kratom in Pennsylvania. The original version of the bill, HB 2357, set out to implement a list of measures prohibiting unsafe and adulterated kratom products. The bill was originally established to ban the sale of kratom made with synthetic ingredients or contaminants, impose strict labeling requirements, and limit kratom sales to adults only.

Most safety aspects of the bill were removed by lawmakers prior to the bill’s passage. Currently, only the minimum age requirement remains. Originally, the bill sought to ban kratom sales to anyone under 21, but the age was ultimately amended to 18. So if the bill is made law, kratom will only be available to adults in Pennsylvania.

The Fight for Safe Kratom in Pennsylvania Isn’t Over

The original Pennsylvania bill—with all of its safety and accountability provisions—was modeled after the Kratom Consumer Protection Act, a set of common-sense regulations developed by the American Kratom Association. Because the kratom market is unregulated in the U.S., there are a lot of unscrupulous vendors who cut corners with product quality and even use synthetic ingredients to make their kratom products addictive.
