Is Kratom Legal in Washington State?

The Evergreen State is one of America’s northern treasures, a fantastic place to visit or to call home. As one of the first U.S. states to legalize cannabis, Washington is regarded for its forward-thinking attitudes about the therapeutic benefits of natural herbs and botanicals. So where does kratom fit into that equation? Is kratom legal in Washington State? 

Is Kratom Legal in Washington State? 

Yes. At the time this blog is being written, kratom is 100% legal in Washington State. Anyone can purchase and possess it, and there are no age restrictions or product regulations in place. In fact, Washington is one of the few states where kratom’s legal status has never been put in jeopardy. 

Kratom is currently legal in 44 states. It has been banned in Rhode IslandWisconsinVermontArkansasIndiana, and Alabama. Some states have also implemented bans at the city and county level—such as we’ve seen in Sarasota County, Florida and San Diego, California. You won’t find these types of local restrictions in Washington. 

Regulating Kratom in Washington

Washington legislators are currently reviewing a bill that would regulate kratom in the Evergreen State. Introduced in 2022, Senate Bill 5941 would establish the Washington Kratom Consumer Protection Act (KCPA). Among other things, this bill would: 

  • Prohibit the sale of kratom products containing non-kratom adulterants
  • Prohibit the sale of kratom with more than 2% 7-hydroxymitragynine (one of the main alkaloids, which usually appears in much lower concentrations)
  • Prohibit the sale of contaminated kratom
  • Limit kratom sales to adults 21 and over

The KCPA is part of a nationwide effort by the American Kratom Association (AKA) to establish a safer kratom marketplace one state at a time. The AKA is working with legislators nationwide to get these regulations passed so that consumers can enjoy safer, higher-quality kratom without having to worry about dangerous products infiltrating the market. States like Arizona, Georgia, Nevada, and Utah have already passed the KCPA. It could also prove to be a game changer for kratom in Washington. 

Neighboring Oregon is also close to passing their own version of the KCPA. Oregon House Bill 4010 was approved by the state legislature during the 2022 legislative session. This law would require kratom vendors to register with the Oregon Department of Revenue and would mandate third-party lab testing for all kratom products. If Oregon and Washington both pass the KCPA, it would provide for a much safer kratom marketplace across the entire northern Pacific Coast.
