Is Kratom Legal in Texas?

Is Kratom Legal in Texas?

The legal status of kratom in Texas is pretty straightforward: You are allowed to purchase, possess, manufacture, or distribute kratom products so long as they’re in accordance with all other laws. In other words, kratom is legal in Texas so long as it isn’t contaminated with any controlled substances or otherwise in violation of Texas law.

Texas is one of 44 states where kratom is legal. And while most other states have at least considered restricting kratom, Texas has never made any such effort. There are no restrictions at the county or city level either, so you can enjoy kratom throughout the state without landing in legal hot water.

But while kratom is legal in Texas, you do have to be careful when traveling to neighboring Arkansas or nearby Alabama. Kratom is prohibited in both of these states, and the penalties for possession can be fierce. In Arkansas, possession of less than 2 grams of kratom is a class D felony punishable by up to 6 years in prison and a fine of up to $10,000 (the penalties are worse for possession of higher amounts). Possession is also a class D felony in Alabama, punishable by 366 days to five years in prison. So if you plan to head out of state with your kratom, make sure to brush up on the laws in every location to which you’re traveling.

As long as you remain within Texas and all other kratom-legal states, you’ll have nothing to worry about. If you plan to drive south of the border for a sunny weekend in Mexico, you should be okay there as well. However, in case you’re stopped by border officials, make sure that your kratom is in its original packaging with the label intact. Other Legal Considerations for Kratom in Texas

Although kratom is legal in Texas and its legal status has never been disputed, there have been multiple efforts to regulate kratom within the state. In 2021, two such bills made their way through the state legislature: HB1097 and SB821.

Both bills sought to establish safety guidelines for kratom in Texas. Though one bill was specific to the House and one to the Senate, they contained much of the same language and carried the same objective. They were modeled after the Kratom Consumer Protection Act, a broad set of safety guidelines developed by the American Kratom Association and already enacted in states like Utah and Nevada.

Among other things, the bills would have:

  • Established labeling requirements for kratom products 
  • Banned synthetically derived alkaloids
  • Prohibited the inclusion of dangerous non-kratom adulterants and contaminants
  • Limited the maximum concentration of 7-hydroxymitragynine (a key alkaloid) to just 2% of the total product
  • Limited the sale of kratom to buyers 18 years of age and older

Despite support from both sides of the political aisle, both bills were ultimately unsuccessful. HB1097 in chamber, and SB821 died in committee. However, advocacy organizations like the American Kratom Association continue to lobby for safe kratom regulations in the Lone Star State. If you’d like to see kratom safety protections made law, write to your local representatives and urge them to adopt the Kratom Consumer Protection Act.

The reason why states continue to debate the legal status of kratom is out of concern for its safety. But the reason why safety remains a problem is because kratom is unregulated in most places. The Kratom Consumer Protection Act would prevent poor-quality products from making their way into the marketplace.
