Let’s Talk About the Legality of Kratom in Michigan

Open Sidebar

Kratom is a natural herb that has been used for centuries in Southeast Asia. It has quickly become popular as an ethnobotanical plant thanks to its uplifting, calming, soothing, relaxing, and even stimulating aromatic effects. However, kratom is also controversial because it’s not regulated by the FDA, meaning there is no regulated quality control or safety testing for kratom products.

If you want to buy kratom in Michigan, here’s what you should know about its legality, legislation, and where to buy it.

The good news is that kratom is legal in Michigan as of right now. You’re free to buy kratom, sell, or possess kratom without any issues. Unlike some states where kratom may be legal but banned in specific counties and even cities, Michigan has no such restrictions. It’s legal in all major cities, including Detroit, Grand Rapids, Lansing, Flint, and Lansing.

This could, of course, change in the future. A bill was introduced in 2018 that would have made kratom a Schedule II controlled substance in Michigan. This would have put it in the same category as drugs like cocaine and heroin. Thankfully, this bill did not pass thanks to advocacy efforts in the state and beyond.

Regulation Efforts are Underway

The Michigan House of Representatives recently had their first hearing on the controversial kratom herb. There are currently no regulations on kratom in Michigan, but that could soon change. The regulation efforts are meant to ensure that kratom buyers know exactly what they’re getting, what quality controls are put into place, and the potential side effects of using kratom.

Michigan Representative Lori Stone, a Democrat from Warren, thinks that kratom in Michigan should be regulated like alcohol or marijuana with a clear framework that ensures all kratom products sold in head shops or online are consistent with what consumers are being told they are, ensuring they’re unadulterated, and ensure that vendors selling kratom are licensed to sell.

Kratom regulation is also pushing for a ban of kratom for anyone younger than 21 and will also require that kratom products come with a label that outlines potential side effects. Despite some calls for a ban on kratom in Michigan, Stone believes that a total ban on kratom would do more harm than good. “A total ban is not the answer,” Stone said. “I think it would create a black market for kratom, and I don’t want to see that happen.”
